OKLAHOMA CITY (AP) -- A federal judge has scheduled a hearing in Muskogee next month on the mental competency of former state Sen. Gene Stipe of McAlester. The hearing will take place October 15 before Ronald A. White, judge for the U.S. Eastern District of Oklahoma.
Stipe returned to McAlester last week after undergoing an examination of his mental competency at the U.S. Medical Center for Federal Prisoners in Springfield, Mo.
At the time, a federal prosecutor said White could still hold a hearing on Stipe's mental status, based upon the judge's observations at Stipe's probation revocation hearing.
Stipe got a five-year suspended sentence in 2004 after admitting to illegally funneling $245,000 into a failed congressional campaign. He is accused of doing the same thing in another campaign in 2006 and of also violating his parole by associating with a felon.
The revocation hearing has been on hold since White ordered Stipe's mental health to be checked. White said it appeared to him at an Aug. 28 proceeding that Stipe was either under hypnosis or on drugs.
The 80-year-old Stipe was forced out of a 53-year legislative career in 2003 after allegations of campaign law improprieties surfaced.
