AMES, Okla. (AP) -- A northwest Oklahoma man faces a second-degree murder charge in the shooting death of his younger brother who served in U.S. Marines in Iraq.

Kristan Newton is free on $50,000 bail in the death of Braden Newton near Ames in Major County.

Kristan Newton told investigators he didn't intend to shoot his brother but was trying to fire a .45-caliber pistol into the air to scare him when the gun went off early and Braden Newton was shot in the head.

Kristan Newton says his brother had changed and become violent after returning from the Marines and that the two argued about a fence before the shooting.
