(Denver-AP) -- A federal appeals court is refusing to stop a lawsuit against fired Oklahoma City police chemist Joyce Gilchrist and retired prosecutor Bob Macy.
Jeffrey Todd Pierce is suing Gilchrist and Macy for allegedly violating his civil rights when he was wrongly convicted of rape. Pierce spent 15 years in prison before DNA evidence cleared him and he was released in 2001.
The appeals court in Denver says Gilchrist can't ``hide'' behind the fact she didn't file charges against Pierce. The court also says Macy made ``misleading'' statements about a judge's rulings in lawsuits against him and Gilchrist.
Gilchrist testified during Pierce's trial that hair left by the rapist was consistent with Pierce. Macy was Oklahoma County District Attorney at the time, but didn't personally take part in the trial.
