(Oklahoma City-AP) -- The state Supreme Court Tuesday refused to review a ruling that a 2001 sales tax election in Tahlequah was not valid.

The court unanimously denied the city's request to review the ruling by the Court of Civil Appeals that city officials failed to publish a legal notice ten days before the election, as required by law.

Tahlequah voters narrowly approved the half-cent sales tax to pay for improvements to Northeastern State University's football stadium.

Attorney Monte Strout represents two residents who challenged the tax and says he'll propose a plan to return to taxpayers the money already collected.
