(Lorain, Ohio-AP) -- An Ohio mother accused of taking lewd pictures of her eight-year-old daughter in the bathtub has avoided going to trial.

Cynthia Stewart has signed an agreement to undergo counseling and to give up two photos prosecutors said were offensive, so they can be destroyed.

A prosecutor says Stewart acknowledged the two pictures could be interpreted as sexually oriented, even though she didn't intend them to be that way.

According to the agreement, once Stewart completes the counseling program in September, all charges against her will be
dropped.

Stewart was indicted on charges of illegal use of a minor in nudity-oriented material and pandering sexually explicit material involving a minor. She says the pictures were simply part of a documentation of her daughter's life.
