(McAlester-AP) -- The Oklahoma Pardon and Parole board today denied clemency for a man convicted and sentenced to death for the
killing of an Elk City police officer.

Board members voted four to zero in rejecting Bobby Ross' request. Ross had just robbed a hotel when he encountered Sergeant Steven
Mahan on January 5th, 1983. Mahan was shot three times in the head by Ross.

Ross' attorney says he will submit a writ of habeus corpus to the U.S. Supreme Court in an effort to save his client's life. Ross is scheduled to die by lethal injection on December 9th.
