It appears a lawsuit dealing with the Tulsa Race Riot could go all the way to the US Supreme Court.
This after a federal appeals court refused to consider a lawsuit filed by survivors and descendents of survivors of the riot.
A three-judge panel ruled in September the plaintiffs waited too long to file their lawsuit. Now most of the judges on the Tenth Circuit court of Appeals agreed and denied a re-hearing. Four justices dissented saying the plaintiffs deserved the attention of the full court.
The riot destroyed large sections of Tulsa's black neighborhoods and some accounts put the number of dead at about 300.
