OKLAHOMA CITY (AP) -- Prosecutors will decide whether an Oklahoma City homeowner who allegedly shot an intruder to death was justified.
Elvin Dwayne Scroggins died early Saturday after he was shot repeatedly with a handgun inside the home of Thomas Fuller.
Fuller told police his door bell rang and he looked outside where he saw Scroggins. Fuller did not answer the door.
A short time later, Phillips says, Fuller heard a noise at the rear of his home. Fuller confronted Scroggins after he entered the home through an unlocked rear door.
Records indicate that Scroggins had 13 felony convictions when he was fatally shot and was on probation on a burglary conviction.
