The final resting place of a soldier killed in Iraq is in the hands of a California judge.
28-year-old Army Staff Sergeant Jason Hendrixwas killed in February. He was buried in Claremore against the wishes of his mother. His father says he should remain in Oklahoma, but Hendrix's mother says her son asked during a phone call before his deployment, that he be buried in California.
Jason grew up in California with his mother, but finished high school living with his father in Oklahoma.
