A grand jury refused to indict a Tulsa County deputy who shot a suspect at a Texas airport during a struggle last year.

Deputies John Werts and Susan Nye were bringing Brent Taff from Utah to Tulsa through Dallas-Fort Worth Airport in February 2015. He was suspected of threatening a violent act against a Tulsa County District Judge.

While they waited for a connecting flight, Deputy Nye waited outside while Deputy Werts took Taff into a restroom. According to TCSO, Taff assaulted Deputy Werts who shot him in the hand.

Taff was tackled by Deputy Nye, airport police and TSA officers. Prosecutors added assault and escape charges to the counts he already faced.

TCSO said Werts resigned earlier this year but did not say why.
