MUSKOGEE, Okla. (AP) -- Muskogee County prosecutors say they won't file charges in a case involving a Muskogee man who died several days after he was badly beaten in a fight at a bus stop.
The Oklahoma medical examiner's office ruled the death of Harold Graves Senior. a homicide but Muskogee County District Attorney Larry Moore said his office lacks the evidence to pursue charges.
Moore announced his decision Monday after meeting with Graves' family.
Graves' family says he suffered three jaw fractures, a skull fracture and some bleeding in the brain after the April 27 fight. He was taken to a Tulsa hospital where he died six days later.
Moore said he would not rule out filing charges in the future if more evidence is uncovered.
