COLLINSVILLE, Okla. (AP) _ Collinsville police have asked the Oklahoma State Bureau of Investigation to look into a fatal shooting over the weekend.
Police believe that Robert Westley, 21, was shot Saturday while breaking into a pickup truck owned by Ronald E. Martin, 61. The pickup was in Martin's driveway.
Martin told police he looked out his window and saw Westley breaking into his truck. Police were told that Martin confronted Westley with a .357-caliber revolver, Collinsville Police Chief Stan Mason said Monday.
The two struggled, and the gun fired once, hitting Westley in the head, Mason said. Martin then called police.
Westley died at Claremore Regional Hospital, Mason said. Martin has not been arrested.
Agents have been conducting interviews and will send their findings to the Rogers County district attorney's office, said Kym Koch, OSBI spokeswoman.
Prosecutors will then decide whether the shooting was legally justifiable, Koch said.
