MUSKOGEE, Okla. (AP) -- A Muskogee police officer who was the subject of a citizen's complaint and an internal investigation is resigning.
Officer Mike Apple is resigning effective Saturday.
A complaint filed against Apple over physical force used while he took a man to the county jail on October 28th.
Marcus Conard says Apple was giving him a Breathalyzer test and became angry when Conard belched, then coughed.
Conard says Apple then told other officers he refused to take the test, which Conard denies.
Conard also says Apple later tried to provoke him before physically attacking him from behind. Conard says he was knocked face-down on the floor of the jail garage.
Apple says he can't comment about the incident until his resignation becomes effective.
