DUNCAN, Okla. (AP) -- A Stephens County prosecutor wants the killer of an Oklahoma Highway Patrol trooper to be sentenced on a drug charge.
Ricky Ray Malone[pictured] has already been sentenced to death for the December 26th, 2003, shooting death of Trooper Nik Green.
But assistant District Attorney Jerry Herberger says he also wants Malone sentenced on a drug charge just in case Malone's death penalty is overturned on appeal.
Malone had been arrested on a methamphetamine complaint and released a few days before he killed Green. Herberger says Malone has pleaded guilty to the charge.
