MUSKOGEE, Okla. (AP) -- The Environmental Protection Agency is reviewing its enforcement options against two men it claims violated the Clean Water Act by building a dam without a permit in Adair County.
The EPA says Darryl Cates and Eddy Murray did not respond to an administrative order issued in March. That order stated that the EPA could seek civil, criminal or administrative penalties if Cates and Murray did not restore the Baron Fork Creek to its normal conditions within 30 days.
EPA spokesman Dave Bary says the dam has been washed away, but Cates and Murray may still be held liable.
